1a) We are Pata Negra House Group (collectively "we", the "Company" or "PNHG") and we own and operate “Iberico-ham.com” site. Our site facilitates a convenient way to shop online over the Internet.
1b) By using our site you agree to be bound by the following terms and conditions. Please read them carefully.
1c) We reserve the right to make changes to these terms and conditions from time to time without providing any prior notification. The amended terms and conditions are effective from the date they are published on our site. Your continued access and use of our site and our services shall represent your unconditional acceptance of the latest version of the terms and conditions.
2. Definitions And Interpretation
2a) “you”, “your” or “the customer” is a reference to the person to whom we are providing the services or delivering merchandise and who is required to pay for the merchandise we delivered.
2b) “Delivery Information” shall mean the information to be given by the Customer upon making of a purchase order of the Products through this Site.
2c) “intellectual property rights” means any and all patents, trademarks, rights in domain names, rights in designs, copyright and database rights (whether registered or not and any applications to register or rights to apply for registration of any of the foregoing), rights in confidential information and all other intellectual property rights of a similar or corresponding character which may subsist now or in the future in any part of the world.
2d) “Disclaimer of Warranties and Limitation of Liability” means the Disclaimer of Warranties and Limitation of Liability applicable to Iberico-ham.com delivery service, which is listed here.
2e) “login account” means the login name and password of Iberico-ham.com account upon registration.
2f) “Privacy Notice” means the policy adopted by us regarding the collection of personal information of customers and site visitors through this site, which is listed here.
2g) “price” is a reference to the selling price of the product on the day of transaction.
2h) “product” is a reference to any items that is selling on this site.
2i) “Pata Negra House Group” shall mean Pata Negra House Group, the seller of the Products on Iberico-ham.com.
2j) “Iberico-ham.com” means this site which is owned by PNHG and used for selling PNHG products.
3a) To register on Iberico-ham.com services, the Customer must be over eighteen (18) years of age.
3b) You agree to provide true, accurate, current and complete information.
3c) The Customer must inform PNHG immediately of any changes to the information that he provided upon registration on Iberico-ham.com services by updating the personal details to enable PNHG to have smooth and effective communication with the Customer.
4a) When you place an order you are making an offer to buy from PNHG the merchandise you have specified at the price stated for those merchandise. You cannot cancel an order once it has been submitted, even if our acceptance or rejection of your order is still pending.
4b) We will acknowledge your order to confirm that we have received your order by email. The confirmation will provide:
4b.1) details of what you have ordered;
4b.2) details of the price charged;
4b.3) information about the progress of your order
You may track your order status online.
4c) We reserve our right not to accept or cancel an order for any reasons at our sole discretion, including but not limited to:
4c.1) no sufficient stock to deliver the merchandise you have ordered;
4c.2) no delivery can be arranged for your area; or
4c.3) one or more of the merchandise you ordered was listed at an incorrect price due to a human or computer error or an error in the pricing information provided.
4d) By using this Site and/or submitting a purchase order of the Products to PNHG through the Site, the Customer confirms, agrees and acknowledges that:
4d.1) all the transactions of sale and purchase of the Products between PNHG and the Customer through the Site are subject to the Terms and Conditions;
4d.2) the Customer has read, understood and agreed to the Terms and Conditions prevalent at the time a purchase order of the Product is submitted to PNHG;
4d.3) The Customer will be responsible for any loss, cost, claim, liability and expense incurred by PNHG or its officer employees or agent or affiliates resulting from the Customer’s breach of any of his obligations under the Terms and Conditions.
4d.4) Iberico-ham.com services is available for non-commercial and domestic use only. PNHG reserves the right to refuse orders from business or that we consider are for commercial or other non-domestic concerns. PNHG at its sole discretion, reserves the right to limit its sales to anyone including the right to deny sales to re-sellers.
5a) The price of the Products ordered through the Site is payable by the Customer to PNHG by credit cards. Payments will be settled in Hong Kong Dollars.
5b) Payment methods are subject to changes at any time. Changes made will be announced through email, social media and posted on this site.
5c) the Customer shall provide PNHG with an accurate credit card information and represents and warrants to PNHG that his use of the credit card is authorized and legal.
5d) We use third party payment service to process online transactions. When you place an order, you agree and accept that your credit card information will be collected, processed by us and a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card transaction, and in no event shall any such losses in whole or in part be borne by us.
6a) For any single order with purchase over HK$500 (after discounts or/and coupons and discount codes), free delivery service will be provided. Otherwise, HK$120 delivery fee will be charged.
6b) Our standard delivery schedule is from Monday to Friday (except holidays), with 2 timeslots (11am-2pm ; 2pm-6pm).
6c) Normally, the order can be delivered by the 3ʳᵈ working day when your order is accepted and payment is confirmed.
6d) Daily order cut-off time is 3pm. If you confirm the order after 3pm, the delivery date will be counted from next working day. Announcement shall be made for any special arrangement.
6e) Delivery service is available for Hong Kong SAR only. Areas specifically mentioned please refer to Weekly Delivery Schedule.
6f) Each order can be delivered to one location only.
6g) Our driver will contact you on the day of delivery to confirm the delivery time.
6h) If you are not available to accept delivery at the designated delivery time, we will contact you for re-delivery arrangement. HK$120 delivery fee will be charged.
6i) You must sign on the receipt to confirm you have received the parcel. Otherwise, you must ensure there is authorized person to receive the parcel at the designated delivery time. Upon your consent and confirmation, we could leave the parcel at reception or management office. Please note that we do not hold any responsibility in the case of damage or loss of the products for the above cases.
6j) Home delivery does not include moving goods into the house. Therefore, the company will not be liable and compensated for any loss or damage if items in the house are damaged during the transportation.
6k) You can choose either delivery service or self pick-up at our office in San Po Kong. Eshop orders are not available to pick up at supermarket stores.
6l) If there are any changes in your delivery address, please contact us within 24 hours after ordered.
6m) Please note that No dry ice is provided in the delivery.
6n) Special arrangements will be made under inclement weather conditions.
6n.1) Typhoon Signal no.8/Black Rainstorm Warning Signal: If the signal is likely to be hoisted within 2 hours, our delivery service will be temporarily suspended. When the signal is issued, the delivery service will be cancelled on the day.
6n.2) In this event, you will be contacted to reschedule delivery time and the delivery will be scheduled 2 working days thereafter at earliest.
6o) We will not compensate for any delay, suspension or rescheduling of the delivery due to any force majeure.
6p) If there are any disputes, Pata Negra House Group reserve the right of final decision.
7. Order Cancellation
7a) Order cannot be changed, cancelled or refunded once it is placed.
7b) We will use all reasonable commercial endeavors to ensure the supplies of products listed on the site. If any product cannot be provided to customers since it is out of stock, we will contact the customer for further arrangement.
7c) The quantity of all promotional items, gifts and redemption items are limited. We will end the promotion or redemption once the item is out of stock. If any of these items are out of stock, there will be no replacement and no further notice.
8. Returns or Exchanges
8a) No return or exchange of merchandise will be accepted for sold products. Please read the returns or exchanges policy as specified carefully before you place an order.
8b) Merchandise may be returned or exchanged within one (1) day of receipt if the merchandise you ordered are faulty, defective or damaged (with no fault on your part), or the merchandise are not what you ordered, or the delivery is of an incorrect quantity, provided that:
8b.1) You can provide valid proof on the detail of the merchandise you required exchange;
8b.2) You can show or upload valid document/proof to show the faulty merchandise are bought from us;
8b.3) Visuals of the faulty product and parcel box are provided as soon as possible through this electronic formas a proof;
8b.4) The merchandise that require exchange are not used and are kept at original state.
8c) Once you meet the above requirements and confirmed by us, we will arrange the exchange with the same merchandise within five (5) days. Merchandise exchange will be limited to one (1) time. We will reschedule a free delivery or self pick-up, exclusive of merchandise exchange at supermarket stores.
8d) Pictures of the Products on the Site may not exactly correspond to the actual description of the Products. In such case, the written description of the Product should be relied upon by the Customer and the Customer shall not be entitled to exchange the Product on the basis that it does not exactly correspond to its picture posted on the Site.
9. Uncontrollable Force
9a.) If due to any uncontrollable reasons (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, public enemy, civil war, insurrection or riot, any law, order, proclamation, regulation, demand or requirement of the Government of Hong Kong or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, power, communications or network failure, delay in transit or other causes whatsoever, whether similar to the foregoing or not), that made us cannot fulfill the responsibilities stated at this site, we will not be responsible for these areas.
9b) For the safety of our employees, we reserve the right of stopping delivery service.
10. Non-confidential Information
10b) When you send the information, it means that you make sure having the ownership of the information/content you sent us, and we will not be conflicting the rights of any third party regarding this kind of information/content.
11a) Without violating Article 12 below, any information, data and all content that you can find on this site are provided to you according to their availability, and are not guaranteed in any form, whether explicit or implicit , Including guarantees for goods or for specific purposes and other guarantees.
11b) We do not represent or warrant that access to our site, or any of its contents will be accurate, uninterrupted, complete, reliable or fault-free. If we are informed of any inaccuracies in the material on the Site, we will attempt to correct the inaccuracies as soon as we reasonably can. You can also report it to firstname.lastname@example.org
11c) Any advice or information obtained from PNHG or during the use of iberico-ham.com services, whether oral or written, does not constitute any guarantee that is not expressively stated in the existing terms and conditions.
11d) The access to the Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the services as soon we reasonably can.
12. Limitation of liability
12a) When you log in, use, or browse this site, you must bear the risks and hazards.
12b) When using this site, downloading or obtaining information in any other form, you need to take the risks and hazards. PNHG does not take any responsibility for any damage caused by your login, use, or download of any content from this site or any illegal interference and access to the IT system, or any virus that affects your computer equipment or other property.
13a) As a service provided to viewers, this website may provide hyperlinks to other websites that are not operated or controlled by PNHG. PNHG is not responsible for the legality, accuracy or functionality of the content of such websites.
14. Modification of these Terms and Conditions
14a) PNHG reserves the right to make amendments to these terms and conditions at its absolute discretion without any prior notice to you. You should review these terms and conditions before submitting any order. By submitting an order, you have accepted the terms and conditions applicable at that time.
15a) The product description, photographs, pictures is for reference only. PNHG does not compensate for the difference between actual description.
15b) PNHG reserves all rights of all pictures listed on this site. Re-creating electronic copies of materials protected by copyright and/or any Intellectual Property rights without the permission of us shall be prohibited.
16. Prevailing Language
16a) If there is any inconsistency between the Chinese and English version, the Chinese version shall apply and prevail.
17. Laws Applicable
17a) The Terms and Conditions shall be governed by the laws of the Hong Kong Special Administrative Region and the Customer and PNHG agree to submit to the jurisdiction of the Hong Kong courts.
